FARM PROPERTY FOR SALE BY TENDER Sealed tenders in writing for the purchase of the property described below will be received by McCulloch Law Office as follows: PROPERTY FOR SALE (owned by Laurette Hillhorst): PARCEL I: N 2 16-8-11 WPM EXCEPTING THEREOUT-an undivided one-half interest in all Mines and Minerals. PARCEL II: E 2 20-8-11 WPM EXCEPTING THEREOUT-an undivided one-half interest in all Mines and Minerals. PARCEL III:W 2 21-8-11 WPM EXCEPTING THEREOUT-an undivided one-half interest in all Mines and Minerals. CONDITIONS OF TENDER: 1.The drafter of the tender has been advised that the cultivated acres, which comprise part of the lands described, are irrigable. However, any interested parties must rely on their own inspection and knowledge of the property. 2. Parties may bid on all the property as a whole or on any half section(s) or quarter section(s) separately. 3. Tenders must be delivered to McCulloch Law Office by 4:00 p. m., Tuesday, November 24, 2009, accompanied by a $5,000.00 deposit cheque payable to McCulloch Law Office. Deposit cheques accompanying unaccepted bids will be returned. 4.The highest or any tender will not necessarily be accepted. TERMS AND CONDITIONS OF SALE: 1. The bidder(s) whose tender(s) is/are accepted will be required to complete an Agreement for Sale covering the terms and conditions of the sale. 2. Possession and adjustment date will be January 1, 2010.

3. In addition to the deposit, the balance owing under any and all accepted tenders must be paid on or before the date of closing, failing which the deposit paid shall be forfeited as liquidated damages and not as a penalty.
